TERMS AND CONDITIONS – VIVID SENSES

These policies are issued by ETONDALE 2017 SRL, the operator of the vividsenses.ro platform.

  1. Introduction

These Terms and Conditions govern the use of vividsenses.ro by visitors and customers. Accessing and using the website constitutes full acceptance of these provisions.

  1. Definitions

Vivid Senses / vividsenses.ro – the trading name of ETONDALE 2017 SRL, with its registered office at 15 Victor Eftimiu Street, Arad, Trade Register No. J02/731/2017, Unique Registration Code (CUI) 37488718.

Website – the online store hosted on the Shopify platform, accessible at https://vividsenses.ro.

User/Customer – any individual or legal entity that accesses the website and places an order.

  1. Formation of the Contract

The contract is considered concluded when Vivid Senses sends confirmation that the order has been dispatched. Until that moment, Vivid Senses reserves the right not to fulfil the order for objective reasons (out-of-stock items, technical pricing errors, etc.), in which case any amounts paid will be refunded in full.

  1. Limitation of Liability

Use of the website is at your own risk. Vivid Senses cannot be held liable for:

Errors in displayed information, prices, or technical specifications resulting from malfunctions of the Shopify platform.

Colour differences between product images (renderings/photographs) and the actual products due to the user's monitor settings.

Delivery delays caused by carriers or force majeure events.

  1. Intellectual Property

All website content (texts, product descriptions, images, logos) is the property of ETONDALE 2017 SRL. Copying or using this content for commercial purposes without prior written consent is strictly prohibited.

  1. Payments and Security

Payments are processed through the secure Shopify Payments system, Apple Pay, and Google Pay.

Vivid Senses does not store bank card details.

For PRE-ORDER products, full payment is required when placing the order.

  1. Delivery and Returns

The specific delivery conditions (the 25 RON delivery fee and the 450 RON free-shipping threshold) and return conditions (sealed products in accordance with Romanian Government Emergency Ordinance No. 34/2014) are detailed on the dedicated pages, which form an integral part of this contract.

  1. Data Protection (GDPR)

Vivid Senses processes personal data in accordance with its Privacy Policy. The Data Protection Officer function is outsourced to Interdata SRL. Contact: dataprotection@interdata.ro.

  1. Fraud

Any attempt to gain unauthorised access to data, modify content, or disrupt the operation of the store will be reported to the competent authorities.

  1. Governing Law

This document is governed by Romanian law. Any dispute will be resolved amicably or, failing that, by the competent courts in Arad.
